How DIFT handles your data.

Information We Collect

When you create a DIFT account we collect your name, email address, password (hashed), professional license number, brokerage or agency affiliation, and geographic market preferences. If you subscribe to a paid plan we collect billing information through our payment processor (Stripe). We do not store full card numbers.

• Account information: name, email, hashed password
• License credentials: license type, number, and issuing state
• Billing data: processed and stored by Stripe; DIFT retains last-four digits and billing zip only
• Usage data: pages visited, features accessed, lead requests made
• Device data: browser type, IP address, general location (country/state)

How We Use Your Information

We use your information to verify your license with the relevant regulatory body (DRE, NMLS, or state DOI), provision your subscription, deliver lead data, send transactional and service emails, and comply with applicable law. We may also use your email address to send you promotional communications about DIFT products, features, and offers from time to time. You can opt out of marketing emails at any time by clicking "Unsubscribe" in any such email or by contacting us at support@trekacorp.com. Opting out does not affect transactional or account-related emails.

Data Sharing

We share data with Stripe (payment processing), AWS (hosting), and state licensing databases (for verification only). We do not sell, rent, or trade personal information to lead aggregators, brokerages, or marketing companies. We may disclose data when required by law or to protect DIFT's legal rights.

Your Rights (CCPA / CalOPPA)

California residents have the right to request a copy of the data we hold about them, request deletion, and opt out of any sale (we do not sell personal data). To exercise these rights, email support@trekacorp.com. We will respond within 45 days.

Data Retention

Account data is retained for the duration of your subscription and for 12 months after cancellation, after which it is deleted or anonymised. Billing records are retained for 7 years as required by tax law.

Cookies

We use essential session cookies to keep you signed in and to prevent CSRF attacks. We do not use third-party advertising or cross-site tracking cookies.

Terms of Service.

Eligibility

DIFT products are available exclusively to holders of an active, valid professional license issued by a US state licensing body: a real estate salesperson or broker license (DRE or equivalent), an NMLS mortgage originator license, or a state property & casualty producer license. You represent and warrant that your license is active and in good standing at all times during your subscription. DIFT reserves the right to suspend access pending verification.

Subscription and Billing

Subscriptions are billed monthly in advance. You may cancel at any time; cancellation takes effect at the end of the current billing period and no pro-rated refunds are issued. Prices are subject to change with 30 days' notice. DIFT does not charge commission splits, referral fees, or per-close fees of any kind.

Lead Data — Exclusivity and Sources

On paid plans, each lead you request is assigned exclusively to your account and will not be delivered to another DIFT subscriber while active. Lead data is sourced from publicly available records, proprietary opt-in flows, and third-party data providers. Because underlying sources are public, DIFT cannot guarantee that another service operating independently from the same public sources will not hold a record for the same individual. DIFT's exclusivity commitment applies only to DIFT's own subscriber base.

Acceptable Use

You agree to contact leads only in compliance with all applicable federal and state law, including the Telephone Consumer Protection Act (TCPA), the CAN-SPAM Act, and applicable state do-not-call regulations. You are solely responsible for your outreach methods and must maintain your own TCPA compliance records. DIFT provides consent documentation for leads sourced through its opt-in flows; you are responsible for verifying adequacy before use.

Not a Brokerage Service

DIFT is a lead-subscription and data service. It is not a brokerage, franchise, or referral network and does not participate in, supervise, or take any interest in your real estate, mortgage, or insurance transactions. DIFT Write-off is a deduction-tracking tool; it is not a tax-preparation service and does not constitute tax advice. DIFT Close is a training content subscription; it is not continuing-education credit and does not constitute legal or compliance advice.

Limitation of Liability

DIFT is provided "as is." To the maximum extent permitted by law, Treka Corporation's aggregate liability for any claim arising out of or related to this agreement is limited to the fees you paid in the three months preceding the claim. DIFT is not liable for missed closings, lead quality, market conditions, or the conduct of third parties.

Governing Law

These Terms are governed by the laws of the State of California. Any dispute shall be resolved by binding arbitration under AAA Commercial Rules in Sacramento, CA, except that either party may seek injunctive relief in any court of competent jurisdiction.

Regulatory disclosures.

Licensing

DIFT is operated by Treka Corporation, an S-Corporation incorporated in California, licensed by the California Department of Real Estate (CA DRE #02437566). DIFT's DRE license is a California license and applies to California real estate activities only. DIFT does not act as a broker in any transaction nationwide and does not supervise licensees. Users engaging in real estate, mortgage, or insurance activities outside California must hold their own valid state-issued license.

DIFT Rates — Post-HPPA Compliance

All mortgage leads delivered through DIFT Rates include documented consumer consent meeting TCPA requirements as interpreted following the FCC's 2024 one-to-one consent ruling. Consent records are available to subscribers on request. The Homeowner Protection Plan Act (HPPA) referenced in DIFT Rates marketing relates to 2025 federal legislation restricting "trigger lead" marketing by credit bureaus to mortgage applicants without explicit consent. DIFT Rates sources leads through independent opt-in flows and is not a trigger-lead product.

DIFT Write-off — Tax Disclaimer

DIFT Write-off is a deduction-tracking and expense-categorisation tool for licensed professionals filing Schedule C. It is not a tax-preparation service, does not provide tax advice, and is not a substitute for a licensed CPA or enrolled agent. IRS standard mileage rates and deduction categories shown in the application reflect publicly available IRS guidance and are updated annually; they do not constitute a guarantee of deductibility for your specific tax situation. Always consult a qualified tax professional before filing.

Competitor Comparisons

Competitive pricing and feature comparisons shown in DIFT marketing materials are sourced from publicly available information and reflect conditions as of the date noted on each comparison (June 2026). Competitor pricing changes frequently; DIFT does not guarantee the accuracy of third-party pricing at the time of your evaluation. Data is provided for informational purposes only and does not constitute an endorsement or criticism of any third-party service.

Communications & TCPA.

Consent to Receive Communications from DIFT

By creating a DIFT account you consent to receive transactional emails (account creation, billing, lead delivery), service-related notifications, and occasional promotional emails about DIFT products and offers. You may opt out of non-transactional and marketing communications at any time by clicking "Unsubscribe" in any marketing email or by emailing support@trekacorp.com. Opting out of marketing does not affect transactional account emails.

Lead Consent Documentation

Leads sourced through DIFT's own opt-in properties include a documented timestamp and consent language meeting the FCC's one-to-one consent standard effective January 2025. Leads sourced from third-party data providers may carry separate consent records; contact documentation is provided with each lead delivery. You are responsible for reviewing consent documentation before placing calls or sending texts and for maintaining your own TCPA-compliance records.

Do-Not-Call

DIFT scrubs lead lists against the National Do-Not-Call Registry on a rolling 31-day basis. This scrub is provided as a convenience. You remain independently responsible for honoring DNC registrations and any state-level do-not-call lists applicable to your license jurisdiction.
